Roommates All Equally Responsible This addendum is intended to clarify to all parties to this lease transaction exactly what is the meaning of a “Roommate”, and what each roommate’s rights and obligations are:
1) each individual roommate shall be sought against for any and all relief and monetary damages that the property owner may seek in the event the collective roommates default on their lease obligations; the tenants fail to pay rent due, or late fees or other fees in accordance with the lease.
2) each roommate shall be equally liable for any damages subjected to the premises, less “normal wear and tear”, that is standard in the residential rental industry. Accordingly, “I (any individual roommate) didn’t cause that damage”, is not a sufficient defense to escape financial responsibility in the event the tenant(s) refuse to pay for property damages beyond normal wear and tear.
3) each roommate risks being individually responsible for the collective debt that other roommates –while perhaps being responsible themselves - may refuse to pay.
4) where efforts to remedy financial losses fail, SDL and/or the owner may report such delinquencies to the major credit repositories naming all parties to the lease (all roommates) as delinquent.
5) no roommate shall convey his or hers tenancy to any new third party (sub-lease) without the express approval of the owner, and such approval may be denied for any reason without cause. Further, any non-approved additional roommates found to be living within the premises shall be deemed a breach of the lease and ALL roommates subject to immediate eviction.
6) the collective security deposit for all roommates shall be held until the premises are dutifully vacated in the usual manner, and the collective net security deposit shall be returned to the primary applicant who shall disburse to the other roommates. SDL does not handle security deposits; the owner does.
