Terms & Conditions for Using Big Bertha


The SDL Real Estate & Property Management Team is pleased to offer Big Bertha for the exclusive use of our clients. This privilege is extended subject to strict terms and conditions. Clients are reminded that SDL is not in the truck rental business; our primary objective is to provide superior real estate and property management services. Big Bertha is but one of many ways in which we provide superior service and we expect all users to treat her as part of our family, NOT just another rental truck! All users shall be aware of and adhere to the following terms and conditions:

Addendum

This Addendum is made a part of the master Truck Rental Agreement and Safety Qualification Record executed at time of pick-up.

Usage Fees & Charges

Pick Up Times always 9:30 a.m.
Return Times always 9:00 a.m.


  • First 24 hour period - No Rental Charge for Truck Use
  • Additional day - $49.00/day
  • Mileage - First 200 miles Free - 45 cents/mile thereafter
  • One Hand Dolly - No Charge
  • 12 High Grade Furniture Blankets - No Charge
  • Additional Dolly - $9.95/day
  • Additional Furniture Blankets - $1.00 each/day
  • Buy-down Accident Deductible to $1,000 - $9.95/day


Reserving Big Bertha

Customers shall reserve Big Bertha by phone or in person at the SDL office only.

We DO accept on-line reservation REQUESTS. We do NOT accept on-line reservations. An SDL staff member shall contact the customer by phone as quickly as possible after receipt of the reservation request to confirm a booking, subject to availability.

A $100.00 reservation hold deposit is taken to hold the reservation. This deposit is applied towards the security deposit upon customer taking delivery.

The hold deposit is refundable in the event the customer cancels the reservation no later than 3 days prior to pick-up, or in the event of one of the following;
  • The real estate transaction (sale or rental) upon which the reservation was based does not complete as scheduled through no fault of customer
  • Death, or serious illness of the customer or spouse

The deposit is non-refundable in the event the customer is a no-show for the pick-up.

As well, the deposit is non-refundable if the customer arrives for the scheduled pick-up and fails to provide the necessary documentation or refuses to provide the required security deposit.

Reservation requests are confirmed on a first-come, first-served basis and are considered confirmed ONLY upon receipt of the reservation hold deposit. A faxed or emailed confirmation will be provided to the customer.

Disclaimer: Non-Availability

SDL makes every effort to make the truck available at the time reserved by the customer. However, the customer understands that the truck may not be available for pick-up at the scheduled time for a variety of reasons beyond the control of SDL including, but not limited to;

  • Mechanical failure
  • Prior motor vehicle accident
  • Late return by another SDL customer
  • Theft of vehicle or other criminal act
  • Any Act of God


and the customer herein agrees to indemnify and hold harmless SDL, and its agents, for any claims for damages that the customer may experience for the inability of SDL to provide the truck at the scheduled pick-up time including but not limited to;

  • Customer costs incurred to rent a replacement vehicle
  • Inconvenience to customer
  • Late move-out from current rental or owner-occupied premises


Documentation & Security Deposit

Copy of valid driver license(s). Driver(s) must be minimum 21 years of age. (max. 2 drivers on contract)

Copy of a valid major credit card (front and back)

The $100.00 "hold" deposit becomes the "security" deposit against the card at time of pick-up.

Upon return of the vehicle in satisfactory condition, the security deposit shall be immediately released in full or subject to any further deductions in accordance with the terms and conditions of the rental agreement.

Copy of valid auto insurance policy.


Care and Control

Safe operation of the vehicle and the personal safety of our clients is our chief objective at all times. Prior to taking delivery of the truck, the customer and an SDL team member shall complete a “Safety Qualification Record” to verify the pick-up condition of the vehicle. Customers will NOT be allowed to check out the truck without first having a complete understanding of the safety requirements.


Upon return, the parties shall complete an inspection of the vehicle, contents and blankets and dollies. Damages noted on the return inspection that were NOT noted during the pick-up inspection shall be deemed conclusively to have been caused while in the care and control of the customer and such damages assessed accordingly at the time of return.

Customer shall not allow any person(s) other than those named in the Truck Rental Agreement to drive the vehicle.


Driver(s) shall not consume ANY alcoholic beverages, controlled substances, or prescription medications that may have side effects that could impair control, while in the care and control of the vehicle.

Roadside Assistance

Roadside Assistance is provided in the event breakdown. Do NOT drive the vehicle under any circumstances if;

  • Brakes fail
  • Tires deflate
  • Smoke emits from under the engine hood
  • The service engine dash light comes on
  • Power steering failure
  • Any loss of mechanical function that prevents controlled operation



Insurance, Deductibles & Claims

Big Bertha is insured for $5,000,000.00 liability. However, customer understands and acknowledges that their own insurance company;

  • May outright refuse any claim that may be subrogated against it in any event of accident or claim
  • May have it’s own policy deduction that may require the customer to pay a minimal deduction against any claim that will not be paid by SDL or SDL’s insurance carrier


In the event of any accident, customer is obligated to pay the first $2500.00 in damage costs as a deductible against any claim, however caused and without regard for fault.

The customer may reduce the deductible to the minimal deductible of $1000.00 for a fee of $9.95 per 24 hour period of truck usage.

In the event of any claim by customer for accident damages, however caused, SDL is authorized by the customer to charge against the security deposit any amount up to $2500.00 in the event customer waives the deductible buy-down, or up to $1,000.00 in the event customer has purchased the deductible buy-down.

In the event of very minor damages (where no police report has been obtained, for example) such as very minor dents or scratches, the customer and SDL shall negotiate a fair charge against the security deposit at the time of vehicle return.

Where the parties cannot agree on a “fair charge” at the time of return, SDL shall obtain, within three business days, a repair estimate from a local body repair shop and this actual amount shall be charged against the customer’s credit card prior to the release of the balance of the security deposit to the customer.

In the Event of a Reportable Accident

Accidents must be reported to the police any time a second party is involved whether or not there is a personal injury to any party.

Procedures:

When such an accident occurs, open the sealed envelope in the glove compartment and follow the instructions carefully.

Complete the accident report accurately and make any drawings that will help the police and/or insurance companies determine cause and fault.

Use the disposable camera provided to take photos that may assist officials to assess cause and fault.

Call the SDL emergency contact number in the envelope.

In the event of total incapacity of the vehicle, call the roadside assistance number provided and direct the towing to their nearest facility. Do not allow any other towing facility to remove the vehicle. Unauthorized towing (including storage and retrieval) by any third party tow company shall be at the cost of the customer, not SDL.

Vehicle Return

The return location is our office. Customers are expected to return the vehicle at the time stipulated in the agreement.

Customers should plan to remain with the vehicle until it has been inspected and checked in by an SDL team member.

Customers who leave the vehicle unattended shall be deemed to have abandoned the vehicle and may be liable for unexpected charges if they have been unable to account for the vehicle at check-in.

Earlier check-in times may be arranged but not guaranteed. SDL staff make scheduling arrangements based on the contracted return time and SDL staff cannot guarantee that a team member will be available at an earlier return time.


Vehicle Condition

Big Bertha is maintained in as clean a condition as possible at all times. Normal wear and tear and cosmetic dirt are acceptable consequences of her frequent use. SDL takes every care to ensure that customers receive a clean vehicle at pick up. Customers are expected to return the vehicle in as clean a condition as possible considering weather and road conditions.

Prior to return, the customer shall ensure that the cab interior is clean of trash and that any food or drink spills have been properly treated.

All furniture pads shall be neatly folded and stacked for counting.


Customers shall NOT:

  • Smoke in the vehicle at any time
  • Drive the vehicle off road at any time


The evidence of either of these activities (smoke odor in the cab and wheel and wheel wells buried in dirt) are easily discernable and customers who engage in either activity shall be charged a cleaning fee of $50.00 per event.


Late Returns

Customers have a 30 minute grace period after the scheduled return time after which the following penalties shall be applied against the security deposit:

  • Between 31-59 minutes late: $50.00
  • Between 1 and 4 hours late: $250.00
  • Between 4 hours and 24 hours late: $500.00
  • Over 24 hours: $500.00 per day until return.


If the customer does not call our office within the first hour after the due return time to explain the reason for the lateness, the vehicle shall be reported to the police as missing.

As well, the following charges shall apply for damages or lost equipment:

  • Damage to Hand Truck Dolly - $negotiable repair
  • Loss of Hand Truck Dolly - $195.00
  • Damage to Furniture Blankets - $negotiable repair
  • Loss of Furniture Blankets - $20.00 each
  • Orange Safety Cones - $20.00 each
  • Lost keys - $50.00
  • Lost Disposable Camera - $25.00
  • Cab Smoke Fumigation - $50.00
  • Cleaning Charge - $50.00



Fuel

Customer receives a fully gassed vehicle and is expected to return a fully gassed vehicle. Upon return, if the vehicle gas gauge does not show full, the customer shall be charged as follows:

  • 7/8 tank showing - $20.00
  • 3/4 tank showing - $35.00
  • 5/8 tank showing - $60.00
  • 1/2 tank showing - $75.00
  • 3/8 tank showing - $90.00
  • 1/4 tank showing - $105.00
  • 1/8 tank showing - $120.00


Other Terms & Conditions

Customer is aware that the Truck Rental Agreement contains additional provisions that are made a part of the conditions for use. This addendum is meant to highlight and clarify those matters that most affect the renter's interests and potential liabilities.
